The United States Attorney’s Office has reached a settlement with a company providing childcare over allegations of failure to comply with the Americans with Disabilities Act.
Following an ADA complaint filed by the parents of a child with epilepsy, Tender Care Learning Centers agreed to implement new non-discriminatory policies, practices, and procedures regarding administration of medication for children with disabilities.
The complaint alleged that Tender Care established a policy to prevent staff from administering prescribed emergency rescue medication. Tender Care will also pay $20,000 to certain individuals identified during the investigation and train staff about ADA compliance. Revised materials for parents of children with disabilities will be posted at the centers as well as post the new policy to the center’s website.
Tender Care Learning Centers has over 20 locations in Connecticut and western Pennsylvania, including one in Mars.
