A lawsuit against the Mars Area School District and some administrators is moving forward after papers were served late Monday afternoon.
Attorney John Corcoran of the Pittsburgh law firm Jones, Gregg, Creehan and Gerace told our newsroom, “We believe the school took inappropriate action by expelling a student without going through the proper manifestation of termination proceedings.”
Corcoran is representing the parents of a child who was expelled from the district. The situation then moved to a hearing officer who found in favor of allowing a lawsuit to move forward.
Attorney Tom Breth is representing Mars School District in this situation and said that it is still too early in the process for the district to respond to the allegations.
“We haven’t determined what kind of response we’re going to file to the complaint but a response will be filed on behalf of the district and the named defendants,” Breth explained.
The district has 60 days from being served to file their response to the complaint in the US District Court for the District of Western Pennsylvania.
