The Pennsylvania Supreme Court will allow for the use of mail-in ballots to continue while the case to decide their constitutionality is ongoing.
The state’s highest court granted an emergency motion Tuesday to allow Act 77 to remain in effect to permit no-excuse vote by mail.
This comes after the state’s Commonwealth Court ruled in January that the two-year old election law is unconstitutional, saying that voters must cast ballots in person per the state’s Constitution.
Oral arguments in this case are still scheduled to begin next week.
