A lawsuit filed by several Summit Township elementary families against the Butler Area School District concerning lead found in water in 2017 is moving forward in the Butler County Court of Common Pleas.
Lawyers for the four plaintiffs and defense parties including the School District and the District’s insurance provider Liberty filed motions before Judge S. Michael Yeager at a hearing Tuesday morning.
The plaintiffs would like the case to be considered a class action suit while the defense is asking for a discovery master to be appointed which would begin the long and complicated process of gathering a large amount information.
Butler Area School District Solicitor Tom King explains:
“There will be an undertaking to review the records of all the kids in that in that school and I expect that there will be a lot of contention about people who want to have their kids’ records reviewed and those who don’t. I’m expecting that there will be quite a bit of involvement of the community in this particular matter.”
The case could last for a long time however the district’s legal expenses are expected to be covered by their insurer.
