The City of Butler has settled a grievance filed by the city firefighters union.
City Council voted 3-2 Thursday to enter into an agreement with IAFF Local #114 to resolve a dispute about the city requiring a civil service test as a condition of promotion.
The union maintained that Firefighter Donald McCoy, Jr. should be promoted to Lieutenant and James Kaufman should be promoted to rank of Captain because the collective bargaining agreement requires these positions to be filled.
Councilwoman and Director of Public Safety Kathy Kline recommended that the settlement be accepted since a grievance decided by arbitrator costs money.
Motions for the two promotions also passed and the firefighters received a total of about $500 in back pay due to the fact that the previous captain retired last month.
Mayor Tom Donaldson abstained from voting for the promotions because he believes the settlement may leave the city open to a lawsuit.
