A felony charge of assault of an unborn child against a Butler County mother was thrown out in court on Friday.
Our news partners at WPXI say that the charge against Kasey Dischman was thrown out due to Criminal Code 2608. That code grants pregnant women immunity from criminal liability from crimes committed against their unborn child.
The case against Dischman began back in June when she admitted to using heroin when she overdosed in an East Butler home while seven months pregnant. Her baby, now four months old, was later delivered and put on life support, and has also suffered brain damage from the incident.
WPXI says that District Attorney Richard Goldinger may appeal the decision. Three additional misdemeanors still await Dischman in Butler County Court.
