The Butler Area School District is moving ahead with filing a lawsuit regarding the playoff eligibility of their football team.
At their Monday meeting, the school board approved a motion to direct the district solicitor to file a suit against the PIAA in the Butler County Court of Common Pleas on Tuesday. According to Solicitor Tom Breth, the district also plans to file “right to know” requests with the WPIAL and other districts relative to conduct of the PIAA in this situation.
“The basis of the complaint is the arbitrary and capricious nature of the action of both the WPIAL and the PIAA and imposing a penalty on the Butler football program for no cause whatsoever,” Breth said.
Breth went on to say that the PIAA bylaws are very clear about when a penalty like exclusion from playoffs can be imposed and the current situation with Butler does not meet any of those specifications.
“This is an egregious violation of their constitution, their bylaws, and it’s not even in the slightest best interest in the student-athletes that participate in Butler’s program,” Breth said. “We intend to pursue this litigation until the court decides that the PIAA needs to comply with its bylaws and that Butler Area School District football program should be permitted to play in the playoff situation.”
