The Butler Area School District has collected some legal fee reimbursement but may need to take further legal action to get what they believe is owed.
According to district solicitor Tom King, the district has received over $100,000 from insurance carrier Liberty Mutual for reimbursement of legal fees sustained by the district. These fees were incurred by the district in order to defend against a class action lawsuit having to do with lead and copper found in the water at Summit Township Elementary School.
Liberty Mutual has not yet paid about $50,000 in legal expenses the district incurred from the legal firm of Burns and White as part of the lawsuit to decide if the insurance carrier owed the district coverage. A judge issued a decision in June in favor of the district in that dispute but further legal action could be necessary to collect that additional money.
Liberty Mutual has retained the services of the Philadelphia-based law firm of Rawle and Henderson to take over for Burns and White for the ongoing defense of the district in dealing with the Summit water situation.
