The Butler Area School District has requested that a former insurer pay for legal council to handle a new lawsuit.
According to District Solicitor Tom King, Liberty Mutual will foot the bill for lawyers to defend the district against a new lawsuit concerning the Summit Township Elementary water situation.
Liberty Mutual paid to defend the district in a previous lawsuit that was dismissed in federal court, but only after a court decision that forced them to pay.
According to King, the next step in this process is the new case, with new plaintiffs, will be assigned to a Butler County judge.
The suit was re-filed against the Butler Area School District last week regarding the levels of lead and copper in the water supply at Summit Elementary. The suit- intended as a class-action case- was filed on behalf of four Butler residents who all have children that attended Summit Elementary in 2016 and 2017.
The suit alleges negligence on behalf of the district and three former administrators- former Superintendent Dale Lumley, former Assistant Superintendent Mary Wolf, and former maintenance director Glenn Terwilliger.
Specifically, the suit alleges the public was not notified quickly enough after tests in 2016 showed levels of lead and copper in Summit’s water supply that were above state standards. Tests were taken in August and parents were not notified by the district until January.
In addition to monetary damages, the suit asks that the district be required to pay for biannual blood testing and physician visits for the next three years for students who attended Summit in 2016 and 2017.
