The ACLU of Pennsylvania hopes a Butler County judge will throw out a lawsuit filed by a group of gas lease holders and a developer.
The suit claims a group of homeowners and parents challenged Middlesex Township’s zoning ordinance that permits Marcellus shale natural gas drilling to intentionally delay it. The lease holders say the ongoing conflict is stopping them from earning money their entitled to.
An ACLU attorney said during a hearing Thursday that the suit should be dismissed because it violates the citizens’ constitutional right to disagree with government action.
Controversy has surrounded these particular wells because they are located very close to the Mars Area School District.
The judge’s decision is expected by the end of the month.
