The Butler Area School Board has authorized their lawyers to pursue a bad faith lawsuit against their insurance carrier if necessary.
According to district Solicitor Tom King, attorneys for Liberty Mutual are declining to pay for defense representation for Butler administrators as well as refusing to reimburse the district for the costs of the suit filed against them by the insurer. A federal judge ruled in favor of Butler earlier this month but Liberty could appeal. Discussions are ongoing.
The board also voted to no longer employ Liberty Mutual as their liability coverage insurance provider. They will pay $16,000 more to utilize CM Regent next year, which was their provider before the agreement with Liberty Mutual.
Finally, the board decided to add $1 million in cyber coverage to their policy in case personal information is hacked from district systems for a cost of $8,500.
