After an appeal by the PIAA put the future of the Butler Golden Tornado’s football season jeopardy, the team has learned they will be playing for the District 10 championship tonight.
A judge on the state Commonwealth Court denied the PIAA’s emergency application for stay—which sought to ban Butler from playing in tonight’s game.
We spoke with Butler Area School District Solicitor Tom Breth before he argued the case yesterday.
“[The PIAA] is going to have to allege and establish that they would be irreparably harmed if the stay is not put in place; that they have a high degree of probability that they would ultimately prevail” Breth said. “They would have to establish that there would be greater harm if the stay isn’t put in place and that the stay is needed to protect the public interest.”
“None of those they are capable of establishing.”
Butler will now take on McDowell high school tonight at Erie Veterans Stadium. WBUT 1050 AM and 97.3 FM will broadcast the action.
