The state Supreme Court has issued a ruling saying that police can use the smell of marijuana to justify a search without warrant, but it can’t be the sole basis.
The trial came before the court after an officer in Allentown searched a vehicle only because he smelled marijuana.
A prior court said that the search was unconstitutional and deemed that the evidence could not be used in court. The Supreme Court’s ruling agreed with that decision.
