The defamation case against former Butler County Commissioner Jim Eckstein is expected to head to trial Wednesday.
Eckstein is being sued in two separate lawsuits but they are being tried at the same time.
Former county Commissioner Dale Pinkerton, current county Human Services Director Lori Altman and her husband, state Trooper Scott Altman are accusing Eckstein of spreading a rumor that Lori Altman received a big pay increase in 2011 in exchange for Pinkerton being let off the hook after he was pulled over for drunken driving.
Pinkerton denies there was ever a DUI stop or a cover-up.
Eckstein maintains he is innocent.
